NT creates new Workplace Health and Safety Act


The Northern Territory has passed the Workplace Health and Safety Act and the Workers Rehabilitation and Compensation Act. These Acts, which are due to commence early this year, separate functions that previously existed in the Work Health Act.

While the legislation has been separated, the Work Health Authority and its administrative arm NT WorkSafe are maintained under the new Acts.

The Workplace Health and Safety Act includes:

  • the introduction and training of Health and Safety Representatives for workplaces
  • training and right-of-entry for occupational health and safety related purposes for authorised union representatives
  • more specific powers for NT WorkSafe Workplace Safety Officers
  • new industry advisory arrangements to the Minister in the form of a ten member Workplace Health and Safety Advisory Council
  • co-ordinates Occupational Health and Safety regulators.

The Workers Rehabilitation and Compensation Act provides consistency by mirroring the provisions of the previous legislation.
