Enhanced protection for small businesses in WA

In future, small businesses in Western Australia will be protected from unscrupulous and exploitative landlords or suppliers by reforms designed to curb unconscionable conduct, as part of The Retail Shops and Fair Trading Legislation Amendments Act 2006.

Under the amendments, shopping centre landlords will not be allowed to intimidate, unduly pressure or use unfair tactics, such as abusing the law, to force a small tenant out of their leaseĀ or business.

Small businesses can form or join tenants' associations to protect themselves and their rights, and to seek redress from the State Administrative Tribunal. Although often susceptible to harsh and oppressive behaviour, such people have not been protected to date under theĀ Australian Government's unconscionable conduct laws.

The new provisions will also apply to business-to-business transactions, such as restricting the supply of goods to small operators.
