Comment on licensing and the scope of building work in South Australia
The South Australian Office of Consumer and Business Affairs has released a discussion paper dealing with licensing and the scope of building work regulated under the Building Work Contractors Act 1995.
The paper, Discussion Paper I Building Work Contractors Act 1995 - Licensing and the Scope of Building Work, has been developed as part of a review of the South Australian builders licensing system.
Stakeholder feedback is sought on matters including:
- the consolidation of the Building Work Contractors Act 1995 and the Plumbers, Gas Fitters and Electricians Act 1995
- extending the scope of coverage of the Building Work Contractors Act (the Act)
- the development of guidance material regarding the scope of licensing or registration
- areas of building work that should be exempt from the Act
- more direction in the Act regarding supervision
- the educational requirements for building work contractors and supervisors
- business training for sub-contractors
- appropriate requirements for initial financial testing solvency information for annual returns
- exemptions of specific work types from the requirement to be licensed
- mandatory continuing professional development.
The closing date for submissions is Monday 4 December 2006.
Any changes to the licensing system will take into account measures introduced by the Council of Australian Governments (COAG) designed to improve mutual recognition arrangements for occupational licences and the up-take of apprenticeships in skills shortage areas.
The review of the Act is being carried out in three parts. Two further discussion papers will be released, one concerned with contracts and building indemnity insurance, and the other with discipline, compliance and the District Court.
